In rare cases, your workplace injury could have been caused by factors totally unrelated to your work or unsafe practices by your employer. For example, your accident could have been caused by an Act of God—an event caused by natural forces that no one could control or prevent. Examples of these include floods, storms, tornados, lightening, and earthquakes. Even if your workplace accident was caused by an Act of God, you could still be entitled to workers’ compensation benefits.

Why Act of God Accidents Could Be Covered Under Workers’ Comp

In New Jersey, workers compensation is a no-fault system. This means that if you were injured on the job, you are entitled to workers’ compensation benefits without having to prove your employer’s fault in causing the accident. Even if you caused you own injuries—with a few limited exceptions—you could receive compensation. In order to obtain benefits, you must show that your accident arose out of and in the course of your employment. You must establish the following:

  • The accident occurred within the period of your employment.
  • You were at a place you could reasonably be expected to be at while at work.
  • You were reasonably fulfilling your job duties or doing something incidental to your job.

If you suffered a workplace injury due to an Act of God, you need an experienced workers’ compensation attorney to help you get the benefits you could be entitled to. I have been helping people like you for over 20 years. Start an online chat or call me at 877-360-0183 to schedule a free, no-obligation consultation to learn how I can assist you.
